By checking the box, I acknowledge that I have read, understood, and voluntarily agree to the following terms:
1. Assumption of Risk
I understand that participating in activities at FitHub YYC—including but not limited to strength training, cardio workouts, CrossFit, sauna use, personal training, and group fitness—comes with inherent risks, which may include but are not limited to:
- Muscle strains, broken bones, dehydration, cardiac events, or burns
- Equipment misuse or malfunction
- Slips, trips, and falls, especially in wet or icy areas
- Exposure to contagious illnesses
- Injuries caused by others
I voluntarily assume full responsibility for any injury, illness, or loss that may result from my participation.
2. Release of Liability
To the fullest extent permitted by Alberta law, I release and discharge FitHub YYC—its owners, employees, contractors, coaches, volunteers, landlords, and affiliates—from all liability for:
- Injury, illness, or death
- Damage to or loss of personal property
- Acts of negligence (excluding gross negligence)
This release applies throughout the entire facility, including gym floors, saunas, changerooms, walkways, stairwells, and parking areas.
3. Indemnification
I agree to indemnify and hold harmless FitHub YYC from any third-party claims, losses, or legal costs resulting from my actions, presence, or breach of this agreement.
4. Medical Release
I confirm that I am in good health and able to participate in physical activities. I accept responsibility for my own medical care and authorize FitHub YYC to secure emergency care on my behalf if necessary.
5. Facility Use Policies
I agree to:
- Use equipment safely and as intended
- Use the sauna at my own risk
- Clean equipment after use and maintain hygiene
- Respect staff, other members, and facility property
- Accept that my belongings are my responsibility
Violation of these policies may result in suspension or termination of access.
6. Media Release
I grant permission for FitHub YYC to use my image, likeness, and/or voice in photos, videos, and promotional material unless I notify the gym in writing.
7. Governing Law & Severability
This waiver is governed by the laws of Alberta, including the Alberta Occupiers' Liability Act. If any part of this agreement is found unenforceable, the rest remains valid and in effect.
8. Acknowledgement
By checking the box on the free trial registration page, I confirm that I have read this entire agreement, understand its terms, and voluntarily agree to be bound by it.
